Terms and Conditions of Use

Alohados is a marketplace platform for accommodations and experiences. These Terms and Conditions ("Terms") govern the access to and use of the Alohados website and/or applications ("Platform"), operated by Alohados ("we", "us", or "our"). By creating an account, browsing, or making a booking, you accept these Terms.

If you do not agree, please do not use the Platform. We also invite you to review our Privacy Policy and our Cookies Policy.


1 Definitions
  • Host: A User who lists and offers an Accommodation or Experience on the Platform.
  • Guest: A User who books an Accommodation or Experience through the Platform.
  • Listing (Accommodation/Experience): Any property, room, space, or activity offered by a Host on the Platform.
  • Rate: The price published by the Host for a booking, inclusive of any applicable fees and taxes.
  • Service Fee: The charge collected by Alohados for the use of the Platform and payment processing services.
  • Account: The user profile created to access the Platform's features and services.
  • User: Any individual who accesses or uses the Platform, whether as a Host, Guest, or both.
2 Scope of Services

Alohados operates as a technology intermediary that facilitates the listing, discovery, and booking of Accommodations and Experiences. Alohados does not own, operate, manage, or control any of the Accommodations or Experiences listed by Hosts. Each booking constitutes a direct contract between the Host and the Guest; Alohados is not a party to such contract and assumes no responsibility for the obligations arising thereunder.

Alohados may offer payment tools and the issuance of receipts on behalf of Hosts through authorized third-party payment processors. The availability of specific features and functionalities may vary by country and applicable regulations.

3 Registration and Account
  • You must be at least 18 years of age and have the legal capacity to enter into binding contracts.
  • You must provide accurate, complete, and up-to-date information and are responsible for keeping such information current.
  • You are solely responsible for maintaining the confidentiality of your account credentials. All activity conducted through your account is presumed to be authorized by you.
  • We reserve the right to verify your identity and/or supporting documentation in accordance with applicable law and our integrity policies.
  • We reserve the right to suspend or close accounts for breaches of these Terms or upon reasonable suspicion of fraud or abuse.
  • Account Deletion: You may initiate the permanent deletion of your account through the app under Profile > Delete Account, or via the web at alohados.com/profile. We will request confirmation to prevent accidental deletions and may require additional authentication for security purposes. If you have active bookings or outstanding balances, you must resolve them prior to completing the deletion process. Upon account deletion, we will cease displaying your profile and content, retaining only the information strictly necessary to comply with our legal, accounting, or fraud-prevention obligations.
4 Bookings, Payments, and Billing
  • By requesting a booking, you accept the Rate, applicable fees and taxes, and the Host's cancellation policy in effect at the time of booking.
  • Payments are processed through authorized third-party payment processors. Anti-fraud verifications may apply.
  • Alohados may charge a Service Fee to the Guest and/or the Host, which will be clearly disclosed prior to booking confirmation.
  • The Host authorizes Alohados and/or its designated payment provider to collect amounts, withhold charges, and perform settlements on their behalf.
  • Invoices or receipts are issued by the Host or by Alohados acting as authorized billing agent, depending on the applicable business model and applicable law.
  • The Guest is responsible for any applicable local taxes and fees (e.g., VAT, occupancy tax, or lodging tax).

Bank and Credit Card Fees

  • International and Cross-Border Transactions: Certain banks and card issuers may impose fees for international or cross-border transactions. If a booking is processed using a payment method issued in a country different from the Host's location, or if the transaction is executed in a currency other than your card's local currency, your issuing bank may apply an international transaction fee.
  • Currency Conversion Fees: Some financial institutions apply additional fees for currency conversion. If a booking is made in a currency that differs from your credit or debit card's primary currency, your issuer may convert the transaction amount and apply a conversion surcharge.
  • Liability and Inquiries: For questions regarding specific fees or exchange rates applied to your transaction, please contact your banking institution or card issuer directly. Alohados assumes no liability for any costs arising from fluctuating exchange rates or issuer-imposed service fees.

Currency Conversion

  • Informational Accuracy: Any currency conversion rates displayed on the Platform are derived from publicly available sources and reflect prevailing market rates at the time of display. These rates may fluctuate between the time of booking and the time of travel.
  • Disclaimer: Conversion rates are provided for informational purposes only. While Alohados endeavors to provide accurate data, we do not guarantee the accuracy or real-time precision of such rates, as they are determined by external factors beyond our control.
5 Cancellations and Refunds
  • Each Listing defines its specific cancellation policy (Flexible, Moderate, Strict, or otherwise). Please read the applicable policy carefully before booking.
  • Refunds, if applicable, are processed in accordance with the relevant cancellation policy and the processing timelines of the applicable payment provider.
  • No-shows and early departures are handled in accordance with the cancellation policy of the respective Listing.
  • In the event of a Force Majeure occurrence, Alohados may facilitate reasonable commercial solutions on a best-efforts basis, without any obligation to guarantee a specific outcome.
6 Host and Guest Obligations

Hosts

  • Publish accurate and truthful information, maintain up-to-date availability and pricing, and comply with all applicable regulations, including licensing requirements, safety standards, and tax obligations.
  • Ensure minimum standards of hygiene and safety, and that all photographs and descriptions in their Listing are truthful and accurate.
  • Manage check-in and check-out procedures, house rules, and Guest services in accordance with the published Listing.

Guests

  • Respect the Listing's house rules, maximum occupancy limits, community standards, and all applicable legal provisions.
  • Accept responsibility for any damages or additional charges arising from their stay, in accordance with applicable law and Alohados's policies.
7 Prohibited Conduct
  • Identity theft, impersonation, fraud, money laundering, or the unauthorized or improper use of credit cards or other payment instruments.
  • Posting content that is illegal, defamatory, discriminatory, violent, or that infringes upon the rights of third parties, including intellectual property rights.
  • Attempting to breach the Platform's security, engaging in unauthorized scraping, reverse engineering, or abusive use of automated tools or bots.
8 Content, Reviews, and Intellectual Property
  • You retain ownership of the content you submit to the Platform; however, by submitting such content, you grant Alohados a non-exclusive, worldwide, royalty-free, and sublicensable license to host, display, reproduce, and distribute it on and through the Platform.
  • All trademarks, logos, software, and other elements of the Platform are the property of Alohados or its respective licensors. No license or right to use them is granted except as expressly set forth herein.
  • Reviews and ratings must be truthful and respectful. Alohados reserves the right to moderate, remove, or restrict content that violates these Terms or applicable law.
9 Third-Party Services

The Platform may integrate third-party services, including but not limited to payment processing, mapping, messaging, and identity verification. Your use of such services may be subject to the terms and policies of the respective third-party providers, which you agree to comply with. Alohados is not responsible for the performance, content, or practices of any third-party services.

10 Personal Data, Privacy, and Camera Usage

The processing of your personal data is governed by our Privacy Policy. Alohados complies with applicable data protection regulations, including Law 1581 of 2012 and related Colombian regulations, where applicable.

Camera Usage

We only request access to your device's camera when necessary for specific Platform functions, and we will clearly state the purpose prior to use.

  • Posting Listings: You may take photos of your accommodation or experience to display in your Listing. For example, if you capture a photo of a bedroom, that photo will be saved to your account and published on your Listing page.
  • Identity or Ownership Verification: You may take a photo of your government-issued ID or property facade to validate your identity or ownership. For example, if you capture your ID document, the image will be used solely for internal verification purposes, stored with encryption, and not disclosed to other users. It will be deleted or anonymized once no longer necessary for legal or security purposes.

We do not use your camera for advertising purposes or to collect biometric data. You may revoke camera permissions at any time via your device settings and continue browsing the Platform; however, certain features (such as posting a Listing or completing verification) may no longer be available.

Deletion of Personal Data: Upon deletion of your account as described in Section 3, we will delete or anonymize your personal data, except where we are legally required to retain it (for example, accounting records and anti-fraud logs within applicable statutory retention periods).

11 Security

Alohados employs reasonable technical and organizational measures designed to protect User information against unauthorized access, disclosure, alteration, or destruction. Notwithstanding these efforts, no system is infallible, and by using the Platform, you acknowledge and accept the inherent risks associated with online communications and digital services.

12 Liability and Limitations
  • Alohados does not warrant the uninterrupted or error-free availability of the Platform, nor does it guarantee the accuracy, completeness, or reliability of content provided by Hosts.
  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALOHADOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, OR NON-PECUNIARY (MORAL) DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE PLATFORM.
  • The total aggregate liability of Alohados to any User, if any, shall not exceed the total amount of Service Fees paid by that User to Alohados during the twelve (12) months immediately preceding the event giving rise to the claim.
13 Indemnification

You agree to indemnify, defend, and hold harmless Alohados and its affiliates, officers, directors, employees, agents, and licensors from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way related to your access to or use of the Platform in violation of these Terms or applicable law.

14 Force Majeure

Neither party shall be held liable for any delay or failure to perform its obligations under these Terms to the extent that such delay or failure results from events or circumstances beyond its reasonable control, including but not limited to natural disasters, armed conflict, pandemic or epidemic, widespread technical or infrastructure failures, acts of governmental authority, or other Acts of God. The affected party shall promptly notify the other party upon becoming aware of such circumstances and shall use commercially reasonable efforts to resume performance as soon as practicable.

15 Suspension and Termination

Alohados reserves the right to suspend or permanently terminate any account and/or access to the Platform for breach of these Terms or upon reasonable suspicion of fraudulent or abusive activity, with or without prior notice. You may close your account at any time. Upon termination, certain obligations shall survive, including without limitation any outstanding payment obligations, ongoing disputes, and the provisions of Sections 8, 12, 13, and 19 of these Terms.

16 Modifications

Alohados reserves the right to update or modify these Terms at any time to reflect changes in applicable law, operational requirements, or business practices. Any updated version will be published on the Platform with the corresponding effective date. Your continued use of the Platform following the effective date of any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Platform.

17 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict-of-law principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms that cannot be resolved amicably between the parties shall first be submitted to conciliation and, if unresolved, to binding legal arbitration before the Arbitration and Conciliation Center of the Chamber of Commerce of Cali, administered by one (1) arbitrator, and conducted in accordance with that Center's procedural rules then in effect.

Nothing in this Section limits any statutory consumer rights recognized under applicable mandatory law.

18 Communications

By creating an account, you consent to receive electronic communications from Alohados related to the Platform, including operational notices, legal disclosures, and commercial communications. You may manage your communication preferences within your account settings or by contacting us at support@alohados.com.

19 Final Provisions
  • Entire Agreement: These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and Alohados with respect to the subject matter hereof and supersede all prior agreements, representations, or understandings.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Alohados. Alohados may freely assign its rights and obligations hereunder.
  • Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
  • No Waiver: The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
